PROVISIONS AND CONDITIONS


Upon receipt of due proof in writing that the Relevant Life Assured has, whilst the Policy is in full force and effect:

(i) Died as a result of injuries caused solely by violent, external and accidental means and there is evidence of a visible contusion or wound on exterior of the body except in the case of drowning or of an internal injury revealed by an autopsy, and that
(ii) such death occurred within 90 days of the accident solely as a result of the same injury and not as an indirect result of any fit, physical defect, illness or disorder, the Company will pay the Sum Assured applicable to this Policy as shown in the Schedule.
1. NATURE AND DEFINITIONS
(i) XYZ is an Accidental Death Policy.
(ii) In these Provisions:
(a) Except where inconsistent with the subject matter or context the singular includes the plural and the masculine the feminine, and vice versa in both cases;
(b) COMPANY means EFU Life Assurance Ltd (Registered and Regulated by Securities and Exchange Commission of Pakistan);
(c) MAIN OFFICE means the address of the Company as shown in the Policy or such other address as the Company shall specify from time to time;
(d) SUBSCRIBER means a customer of Telecom Facilitator who has opted for XYZ cover;
(e) LIFE ASSURED means a Subscriber whose name appears on Certificate of Insurance;
(f) INUSURANCE COVER means the insurance services availed by the Subscribers of Telecom Facilitator under this Policy;
(g) SUM ASSURED means the insured amount as stated on the Certificate of Insurance;
(h) COMMENCEMENT DATE shall be the date this policy takes effect;
(I) RENEWAL means continuation of risk under the policy upon payment of regular premiums;
(j) DUE DATE means the date on which the premium is due to be paid;
(k) LAPSED means termination of insurance cover due to non-payment of premiums;
(l) RESTORATION means re-continuation of insurance cover upon payment of premium;
(m) EVENT means death of the Life Assured;
(n) DEATH means death by accident;
(o) ACCIDENT means bodily injury which is caused solely by violent, external and accidental means and resulting directly and independently of all other causes;
(p) DEATH BENEFITS means the Sum Assured of the Policy as defined in Clause 6 hereof;
(q) BENEFICIARY means the person nominated by the Life Assured or the Legal Heirs who are eligible to receive the benefits under this policy as per the succession certificate granted by the court of competent jurisdiction;
Provides that after subscription to insurance policy, life assured must nominate either spouse or any of blood relatives like father, mother, son, daughter, brother, sister or grandparents (all real) as beneficiary to obtain the claim proceeds in the event of his death.

Where life assured has not nominated any beneficiary in his lifetime or the nominated beneficiary is not alive at the time of death of the life assured, the claim will be payable to the legal heirs who are eligible to receive the benefits as per the succession certificate granted by the court of competent jurisdiction.
(r) TELECOM FACILITATOR means Warid Telecom who facilitate the Company to disseminate information relating to Insurance Cover, to receive & forward Subscribers’ request and to collect Insurance Premium from Subscribers;

Provides that Telecom Facilitator would share name, CNIC & Mobile numbers of subscribers with the Company for purpose of providing insurance services to them;

Further; it is sole responsibility of the subscriber to update his correct particulars (CNIC and Name) in the records of Telecom Facilitator.

(s) MIS means Management Information System which refers to sharing of information critical to manage this Policy effectively and efficiently in format specified by the Company;
(t) SHORT CODE means 9898 special SMS code which will be used to disseminate information relating to Insurance Cover using automated services and to facilitate Subscribers to communicate with the Company;
(u) SMS means a short message service facilitated by the Telecom Facilitator to or from the Company, as the case may be, for exchanging information relating to Insurance Cover.

2. OWNER
This Policy shall belong to the Life Assured and all the benefits thereunder be payable to the Life Assured’s beneficiary in accordance with Clause 1(ii) (q) of the Provisions and Conditions.

3. EFFECTIVE DATE OF THE POLICY
The Policy shall not be effective until deduction of the premium from the Life Assured through Telecom Facilitator in accordance with Clause 4 of the Provisions and Conditions.

4. AMOUNT AND CALCULATION OF PREMIUM
All premiums payable under this Policy shall be paid to the Company on a predetermined frequency set out in the Certificate of Insurance with the amount of the premium being charged to the Life Assured. The Telecom Facilitator shall collect the premium from the Life Assured and the same shall be remitted to the Company’s account along with appropriate MIS.

The premium for each Life Assured shall be such as is required in accordance with the agreed premium rates to provide the individual Sum Assured in respect of the Life Assured.

5. GRACE PERIOD
A Grace Period of three days is allowed for the payment of any Regular Premium after the first, during which period the Policy shall remain in force.

6. BENEFITS PAYABLE
Upon receipt of due proof in writing that the Life Assured has, whilst the Policy is in full force and effect, as a result of injuries caused solely by violent, external and accidental means died then the Company subject to the exclusions, terms and conditions shall pay the benefit as set out in the Certificate of Insurance.

7. CASH VALUE
The Policy shall not participate in the profits of the Company and does not have any Cash Value.

8. TERMINATION OF THE POLICY
The Policy shall be terminated on any of the following:
a) The Life Assured’s death;
b) Cancellation of this insurance coverage by the Telecom Facilitator;
c) Notice from the Life Assured that the insurance be cancelled;
d) Non-payment of premiums for a period of three (3) days after they have become due;
e) Any other date on which the Life Assured ceases to be eligible for assurance for any fraudulent or criminal reason affecting the assurance hereunder. Decision of the court shall be final in such cases.
f) If the connection of the Subscriber shall be terminated in accordance with the terms and conditions and laws applicable on the cellular services.

Notwithstanding anything to the contrary in this Policy, the termination of this Policy shall have the following effects:
a) No Sum Assured shall be payable under this Policy on the death of the Life Assured after the time of termination;
b) No premium shall be payable under this Policy after the time of termination.

9. RENEWAL
The risk cover under the policy is for a period of one week starting from the subscription date and shall be renewed for another period of one week upon payment of regular premium and so forth.

10. LIMITATIONS & EXCLUSIONS
A subscriber will only be eligible for one insurance policy at a time irrespective of number of mobile phone connections he holds.

Further; no benefit shall be payable if the death of the Life Assured results directly or indirectly, wholly or partly as a result of or related to:
a) General checkups, any mental or nervous disorder or rest cures;
b) Suicide, intentional self-inflicted injury, murder, assault, assassination, injury sustained through firearm injury participation in any criminal act or violation of law;
c) Failure to seek or follow medical advice, taking of alcohol or drugs;
d) Heatstroke or sunstroke, poison, gas or fumes;
e) Disease and incapacity or bodily injury which existed prior to this Assurance;
f) Atomic energy explosions of any nature whatsoever;
g) War, invasion, act of foreign enemy, hostilities (whether war be declared or not), armed or unarmed truce, civil war, mutiny, rebellion, revolution, insurrection by military or usurped power, riot or civil commotion, an illegal organization or an industrial dispute;
h) Participating or practicing a dangerous sport, including big game shooting, hang-gliding, hot air ballooning, parascending, steeplechasing, polo playing, horse racing, underwater diving, power boat racing, mountaineering, rock climbing, caving, pot holing and all forms of motor sports and motor cycle sports, including time trials and hill climbs;
i) Participating in exercises or operations while serving with either of the armed or paramilitary forces or while performing any form of police duty;
j) Travelling in an aircraft other than as a fare paying passenger;
k) Pregnancy or childbirth;
l) Catastrophes such as floods, epidemics etc resulting in 250 or more deaths;
m) Human Immuno Deficiency Virus (HIV);

11. ASSIGNMENTS
The assurances provided for under this Policy and the benefits payable hereunder are not assignable.

12. CLAIMS
Written notice of claim must be presented to and received at the Main office of the Company issuing the Policy within ninety (90) days of the death of the Life Assured. The Beneficiary will provide, at his own expense, all certificates, information and evidence required by the Company in respect of claims. The assurance effected hereunder shall carry no surrender or paid up value.

13. CHANGE OF OWNERSHIP
If the business of the Telecom Facilitator shall be transferred to or succeeded by any person or corporation then, subject to the consent of the Company, the payment of premiums under this Policy may at the option of such person or corporation be continued in which case such person or corporation shall as from the date of such transfer or succession take the place of and be treated for all purposes of this Policy as being the Telecom Facilitator hereof.

14. RESTORATION
If insurance cover under this Policy shall not remain inforce due to non-payment of regular premium it may, at the discretion of the company, be restored subject to such terms and conditions as the Company may require. The risk shall however be revived from the date of payment and the company shall not be held liable for any claim(s) incurred while the policy was lapsed.

15. SEVERABILITY
If any one or more of the provisions contained herein shall, for any reason, be held invalid, illegal or unenforceable in any respect, such provision or provisions shall be ineffective only to the extent of such invalidity, illegality or unenforceability, without invalidating the remainder of such provision or provisions or the remaining provisions of this Policy, and this Policy shall be construed as if such invalid, illegal or unenforceable provision or provisions had never been contained herein.

16. LAW
This Policy shall be deemed to be made in, and in all respects shall be inter¬preted, construed and governed by and in accordance with the substantive laws of Pakistan without giving effect to provisions relating to choice of law or conflict of laws. Any courts of competent jurisdiction in Karachi have exclusive jurisdiction to entertain suits/cases and other matters arising out of or under this Policy. The provisions of this shall survive termination of this Policy.

17. STATUTORY FUND
Under the provisions of the Insurance Ordinance 2000, this policy and any additional benefits shall be referable to the Conventional Business Statutory Fund of the Company. The Company may by endorsement to the Policy change the Statutory Fund(s) to which the policy and any additional benefits are referable.

ACKNOWLEDGEMENTS


The Subscriber/Warid Customer acknowledges that:

a) The Insurance Service is of the Company and provided by the Company, and Warid is only facilitating the Company to provide the Insurance Services through its telecommunication network as medium, and when the Warid Customer shall Subscribe into the Insurance Service the Warid Customer for the purposes of the Insurance Service shall become the customer of the Company;

b) Warid gives no warranty (whether express or implied) whatsoever with respect to the Insurance Service and shall not be responsible for any grievance of the Warid Customer/Subscriber relating to the Insurance Services and the Company’s performance of its obligations;

c) After becoming the Subscriber in the Insurance Service, Warid Customer/Subscriber permits Warid to share his details and information available with Warid and as sought by the Company for inter alia processing of the Policy, providing the Insurance Service and payment of Sum Assured, and Warid Customer/Subscriber agrees and acknowledges that he or his legal heirs shall not hold Warid responsible for any consequences of sharing such information;

d) Fraud or abuse relating to Re-Load may result in forfeiture/cancellation of the Policy, suspension of Warid Services of the Customer/Subscriber and termination of his Connection; and

e) While availing the Insurance Service he shall not respond to any calls/SMSs directing to make/send calls/SMSs to any other number/short code or which are regarding award of any prize (whether money or in kind) in lieu of balance transfer or any call. Ignorance of this clause by WaridCustomer/Subscriber shall not accrue any liabilities/responsibilities on the Company or Warid including but not limited to liability/responsibility towards any loss occurred to Warid Customer/Subscriber.
